COLD FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey Contest

1. ELIGIBILITY

To be eligible to enter the Cold FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey Contest (the “Contest”), you must be a legal resident of Canada and you must be of the age of majority in the province or territory of residence at the time of entry in the Contest. Directors, officers and employees of Safeway, COLD FX and their affiliates, VANOC and agencies and their immediate family (father/mother, brother/sister, son/daughter or persons living under the same roof with them are not eligible to enter this Contest.)  
 
2. HOW TO ENTER
NO PURCHASE NECESSARY.
To enter Contest on COLD-FX2010.com or Cold-FX.ca, users must visit the website from Tuesday 1 September, 2009 at 12:01AM EST to Sunday, November 29, 2009 at 11:59PM EST to enter for a chance to win. Entrants must complete in full the official online entry form, including full name, address including province and postal code, daytime telephone number and e-mail address. To be eligible entries must be received no later than 11:59PM on Sunday November 29, 2009.
 
Entrants can enter from Tuesday 1 September to Sunday November 29, 2009 

Sponsor is not responsible for lost, late, garbled, incomplete, or misdirected entries, or entries that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. The use of computer programs and other automatic means to submit multiple entries is prohibited.

Entry forms become the property of COLD FX.
 
3. PROCEDURE FOR AWARDING PRIZES 
On or about Tuesday December 15, 2009 at approximately 10AM EST in Toronto, Ontario, a potential winner will be selected by a random draw among all eligible entries for one (1) COLD FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey vacation prize. To be declared a winner, the selected entrant must meet all eligibility criteria, have correctly answered the mathematical skill testing question, and must complete and return to Sponsor a signed Declaration and Release within the time period indicated in the documents. Entrants are only eligible to win one (1) prize.

Attempts will be made by COLD-FX to contact the selected entrants by telephone and/or e-mail for a period of two (2) days from the first attempt of contact. If any selected entrant cannot be contacted within the two (2) days period or if contacted does not confirm arrangements for his/her prize with COLD-FX or meet all of the contest conditions to be declared a winner, by no later than two (2) days after being contacted, he/she shall be disqualified and COLD-FX reserves the right, in its sole and absolute discretion, to randomly select another eligible entrant as the winner, in the same manner.

The odds of winning a prize are dependent upon the number of eligible entries received.
 
4. DESCRIPTION OF PRIZE
There will be one (1) Grand Prize awarded as a COLD-FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey vacation package for two (2) adult persons to the Vancouver 2010 Olympic Winter Games in British Columbia, Canada (the “Games”). The approximate retail value of the Grand Prize is seven thousand five hundred Canadian dollars ($7,500).

1) The Grand Prize consists of a four (4) day/three (3) night stay at a Vancouver area hotel and two tickets to the Vancouver 2010 Olympic Winter Games Gold Medal Hockey. Details on the hotel, tickets and other Grand Prize package facts will be emailed to the winner as they become available.

2) The Grand Prize also includes: a. A sum of three thousand Canadian dollars ($3,000) that can be used by the Grand Prize winner to pay for transportation into and out of Vancouver for the scheduled COLD-FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey package dates and times. The Grand Prize winner is responsible for arranging his/her own transportation and that of his/her guest (sometimes collectively, the “Grand Prize Participants”) into and out of Vancouver. It is strongly recommended that the Grand Prize Participants book their in-bound and out-bound transportation as soon as scheduled dates and times for the COLD-FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey package are known, due to expected high travel demand throughout the duration of the Games. If travel expenses are less than three thousand dollars ($3,000) for the Grand Prize Participants, the Grand Prize winner may keep any remainder. If travel expenses exceed three thousand dollars ($3,000) for the Prize Participants, the excess costs will have to be covered by the Grand Prize winner. In no event will the Contest Sponsor be responsible for these excess costs;

3) The Grand Prize must be accepted as awarded by the Contest Sponsor. Except for the cash component of the Grand Prize, no cash alternatives, substitutions, divisions, or transfers of the Grand Prize will be allowed, and the Grand Prize winner shall not be entitled to convert the Grand Prize into cash. The Contest Sponsor reserves the right to substitute the Grand Prize with a prize of equal value or greater value.

4) Once a registration has been completed, no changes are permitted.

Tickets to the 2010 Winter Games, whether awarded as a prize and/or are included as part of a promotion, must be accepted as awarded and are subject to all of the applicable terms and conditions prescribed to such tickets from time to time by the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (VANOC). Such terms and conditions are contained in the Ticket License Agreement (which can be reviewed at www.vancouver2010.com), on the back of the physical ticket (once issued) and include prohibitions against any use of the ticket in connection with any commercial promotion or contest (without the consent of VANOC) and the unauthorized sale of the ticket in excess of face value of the ticket. By accepting tickets as a prize and/or as part of a promotion, the holder is deemed to have accepted all of the applicable terms and conditions.
 
5. GENERAL RULES
5.1 To be declared a winner, each selected entrant must first correctly answer a mathematical skill-testing question.

5.2 By entering the Contest, each winner agrees to permit COLD FX and its respective advertising and promotional agencies to use the winner’s name and/or likeness (including without limitation his/her photograph), and/or his/her voice and statements regarding the contest, for any advertising or promotional purposes connected with this contest, in any media whatsoever, including without limitation, on any website operated by COLD FX, without payment of any kind to the winner.

5.3 Each winner shall sign a document attesting to his/her eligibility as stipulated in paragraph 1 of these rules and releasing COLD FX, VANOC, its affiliates, as well as its respective directors, officers and employees, from all liability for any damage or loss arising from participation in this Contest or from the awarding, acceptance or use of the prize.

5.4 The prize shall be accepted as is and may not be exchanged for an amount of money, nor sold nor transferred. No substitutions will be allowed.

5.5 If the prize cannot be awarded as described in these rules, COLD FX, its affiliates, as well as its respective directors, officers and employees, reserve the right to substitute a prize or prize component with another of comparable value.

5.6 Refusal to accept the prize releases COLD FX, its affiliates, as well as its respective directors, officers and employees, of any responsibility and obligation toward the winner.

5.7 COLD FX and its affiliates, VANOC and agencies and its respective officers, directors, employees, agents or representatives shall assume no liability resulting from: (i) losses, delays, typographical errors, poor technical or phone operations, loss or stealing of data-processing, breach of software or computer equipment, losses of communication facilities, text messages or e-mails or fraudulent entries; (ii) any failure of the Cold FX Vancouver 2010 Olympic Winter Games Gold Medal Hockey Contest broadcasts or contest website during the contest period; (iii) any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software; (iv) failure of any e-mail or entry to be received by COLD-FX on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof; (v) any injury or damage to an entrant’s or any other person’s computer or cell phone related to or resulting from participating or attempting to participate, in the contest. COLD-FX reserves the right, in its sole and absolute discretion, to amend, suspend or terminate this Contest should a virus, bug or other cause beyond the reasonable control of COLD-FX corrupt or adversely affect the administration, security, impartiality, or intended operation of this contest, including without limitation the operation of the contest website. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, COLD-FX reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are late, illegible, generated by robotic programming, falsified, or tampered with in any way.

5.8 COLD FX, and its respective affiliates, VANOC and agencies and its respective officers, directors, employees, agents or representatives shall assume no liability of any kind whatsoever in any cases in which their inability to act, results from an event or situation unforeseeable or beyond their control, including more particularly a strike, lock-out or any other labour dispute in its place of business or the location of any other relevant third party.

5.9 All personal information, such as name, address, telephone number, e-mail address and age submitted with an entry, is collected solely for the purposes of administering this Contest and shall not be used for any other purpose without consent. By providing this information, all entrants consent to it being used for the stated purposes.

5.10 Entrants agree to abide by these Contest rules and by all decisions of COLD-FX are final and binding with respect to all aspects of the Contest, including, without limitation, eligibility and/or disqualification of entries.

5.11 The Contest rules are available by logging on to COLD-FX2010.com or Cold-FX.ca from Tuesday 1 September, 2009 to Friday December 4, 2009.
